Welcome to the SportIntel family of services operated by certain sport-specific limited liability companies affiliated with The Other Sports, Inc., a Delaware corporation.

These Terms of Use, together with any additional terms, policies, disclosures, or order forms referenced herein, govern your access to and use of the websites, software platforms, athlete profiles, reports, analytics, subscriptions, consulting services, communications, and related products and services offered under the SportIntel brands, including but not limited to:

  • SwimIntel, operated by SwimIntel, LLC
  • EndZoneIntel, operated by EndZoneIntel, LLC
  • Any additional sport-specific “Intel” service or brand that posts or links to these Terms

Each such sport-specific company is referred to in these Terms as the “Applicable SportIntel Entity,” “we,” “us,” or “our.” The particular company responsible for the Services you use is the entity identified on the applicable website, order page, invoice, receipt, account page, or service-specific disclosure.

The Other Sports, Inc. may provide administrative, technical, operational, billing, customer support, marketing, data, or other services to the Applicable SportIntel Entity. Unless expressly stated otherwise, your contract is with the Applicable SportIntel Entity providing the Services you access or purchase.

By accessing or using the Services, creating an account, claiming or creating a profile, purchasing a subscription, purchasing a one-time service, or otherwise interacting with the Services, you agree to these Terms.

If you do not agree to these Terms, you must not use the Services.

1. Definitions

For purposes of these Terms:

“Services” means the websites, applications, platforms, databases, athlete profiles, rankings, ratings, reports, analytics, recommendations, subscription services, consulting services, communications, and related products or services offered by an Applicable SportIntel Entity.

“SportIntel Service” means a sport-specific service or brand operated by an Applicable SportIntel Entity, such as SwimIntel, EndZoneIntel, or another future sport-specific service.

“Applicable SportIntel Entity” means the specific LLC responsible for the SportIntel Service you access or purchase.

“User” means any person who accesses or uses the Services, including athletes, parents, guardians, coaches, recruiters, sponsors, schools, clubs, organizations, or other users.

“Athlete” means an individual whose athletic, academic, recruiting, biographical, performance, or profile information appears in or is submitted to the Services.

“User Content” means content, information, images, video, links, profile details, biographical information, contact information, athletic data, or other materials submitted, uploaded, linked, provided, or made available by a User.

“Reports” means written evaluations, Best Fit Reports, Scout Reports, athlete assessments, recruiting summaries, analytics, rankings, team fit assessments, projections, recommendations, or similar outputs generated or provided through the Services.

2. Acceptance of Terms; Eligibility

By using the Services, you confirm that you are at least 14 years old.

Only athletes aged 14 or older may create, claim, or manage an athlete profile. If you are under 18, you represent that you have the permission of a parent or legal guardian to use the Services.

If you are a parent or legal guardian using the Services on behalf of a minor, you agree to these Terms on your own behalf and on behalf of the minor.

If you are entering into these Terms on behalf of an organization, including a school, club, team, business, recruiting service, sponsor, or other entity, you represent that you have authority to bind that organization to these Terms.

3. Applicable Entity; Shared Terms Across SportIntel Services

These Terms are intended to apply across multiple SportIntel Services.

The Applicable SportIntel Entity for a specific service may vary by sport, brand, website, subscription, purchase, or product. For example, SwimIntel-related services may be provided by SwimIntel, LLC, while EndZoneIntel-related services may be provided by EndZoneIntel, LLC.

By using a specific SportIntel Service, you agree that the Applicable SportIntel Entity for that Service is the contracting party responsible for that Service, except where these Terms expressly provide rights, protections, or obligations for The Other Sports, Inc. or other affiliates.

The Other Sports, Inc. and affiliated entities may share infrastructure, support resources, technology, personnel, administrative services, and business operations across the SportIntel Services.

4. Athlete Profiles and Data

a. Profile Creation and Claiming

We may create initial athlete profiles using publicly available performance data, competition results, roster information, team information, recruiting information, public statistics, user-submitted data, third-party sources, or other available information relevant to a particular sport.

These profiles may contain errors, omissions, outdated information, duplicate records, or incomplete data. Athletes, parents, guardians, or authorized users may be able to claim, create, update, or correct profiles through the Services.

b. Accuracy of Data

We strive to provide useful and accurate information, but we do not guarantee that any athlete data, rankings, statistics, times, results, measurements, ratings, reports, projections, team data, recruiting data, or other information is complete, accurate, current, or error-free.

You are responsible for reviewing information associated with any profile you create, claim, manage, or rely upon. We are not liable for inaccuracies, omissions, outdated information, or errors in athlete profiles, reports, analytics, rankings, or related data.

c. Profile Images and User Content

Users may be able to upload or provide profile images, biographical details, performance information, video, links, contact information, academic information, athletic information, or other User Content.

You represent and warrant that you have all rights and permissions necessary to submit, upload, link, provide, or authorize the use of your User Content and that your User Content does not infringe, misappropriate, or violate any third-party rights or applicable law.

By submitting, uploading, linking, or providing User Content, you grant the Applicable SportIntel Entity and its affiliates, including The Other Sports, Inc., a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, process, analyze, transmit, distribute, create derivative works from, and otherwise use the User Content as reasonably necessary to operate, provide, improve, market, and support the Services.

We may remove, restrict, or disable access to User Content that we determine, in our discretion, is unlawful, inappropriate, misleading, infringing, harmful, or otherwise inconsistent with these Terms.

5. Reports, Analytics, Evaluations, and Recommendations

The Services may include Reports, including but not limited to Best Fit Reports, Scout Reports, athlete evaluations, written assessments, sport-specific analytics, team analytics, rankings, ratings, comparisons, recommendations, projections, or similar outputs.

Reports may be generated using a combination of public data, user-submitted data, proprietary methodologies, analyst judgment, third-party information, sport-specific performance data, coach or team data, video, statistics, algorithms, and other available information.

Reports are provided for informational, educational, recruiting, evaluation, or planning purposes only. They are not guarantees of:

  • Recruiting interest
  • Scholarship offers
  • Admission to any school
  • Roster placement
  • NIL opportunities
  • Brand sponsorships
  • Athletic performance
  • Future improvement
  • Team fit
  • Coach response
  • Any specific outcome

Reports may include subjective judgments, estimates, opinions, assumptions, and limited available information. Coaches, athletes, parents, schools, sponsors, and other users are responsible for conducting their own independent evaluation.

We may revise, update, remove, restrict, or discontinue Reports or analytics at any time.

6. Video, Film, Images, and Third-Party Content

Certain Services may allow or require Users to submit, upload, link, or provide access to race footage, game film, highlight reels, training clips, profile images, statistics, or other content.

If you provide any video, image, link, or third-party content, you represent and warrant that you have the necessary rights, licenses, consents, and permissions to provide that content to us and to authorize our use of that content in connection with the Services.

You acknowledge that certain videos, broadcasts, statistics, images, or other content may be owned or controlled by third parties, including meet operators, event organizers, schools, teams, leagues, clubs, broadcasters, photographers, athletes, parents, guardians, or media companies.

You agree not to submit, upload, link, or provide access to content that you do not have the right to share for use in connection with the Services.

7. Sharing with Coaches, Recruiters, Schools, and NIL Sponsors

The Services may allow athletes, parents, guardians, or account holders to opt in to sharing certain information with college coaches, recruiters, schools, teams, NIL brand sponsors, businesses, or other authorized third parties.

This information may include contact information, “About Me” details, profile information, athletic information, academic information, performance data, Reports, images, video links, or other information you choose to provide or make visible.

If you opt in to sharing information, you authorize us to make the selected information available to the applicable authorized third parties.

We do not control and are not responsible for how third parties use information after it has been shared at your direction or with your authorization. Third parties are responsible for complying with applicable laws, rules, and policies governing their use of such information.

8. Privacy

Our collection, use, disclosure, and protection of personal information is described in our Privacy Policy.

By using the Services, you acknowledge that you have reviewed the applicable Privacy Policy and understand that personal information may be collected, used, disclosed, and processed as described therein.

Because the Services may involve minors, athletes, recruiting information, contact information, and optional sharing with coaches or sponsors, parents and guardians should carefully review account settings, profile visibility, sharing choices, and privacy disclosures.

9. Ownership; Limited License

The Services, including all software, databases, rankings, ratings, analytics, Reports, written evaluations, methodologies, formats, user interfaces, designs, trademarks, service marks, logos, trade names, content, and other materials provided by us, are owned by the Applicable SportIntel Entity, The Other Sports, Inc., their affiliates, or their licensors.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, educational, recruiting, athletic, coaching, organizational, or internal business purposes, as applicable.

You may not copy, modify, scrape, harvest, reproduce, distribute, sell, resell, sublicense, publicly display, create derivative works from, reverse engineer, or commercially exploit the Services or any data, Reports, rankings, analytics, or other materials made available through the Services except as expressly permitted by us in writing.

10. Prohibition on AI Training, Scraping, and Competitive Use

Except as expressly authorized in writing by the Applicable SportIntel Entity, you may not access, scrape, harvest, collect, extract, index, copy, store, download, reproduce, use, or otherwise exploit any portion of the Services, including athlete profiles, rankings, analytics, Reports, team data, coach data, recruiting information, statistics, or other content, for the purpose of:

  • Creating datasets;
  • Training, fine-tuning, validating, benchmarking, operating, or improving any machine learning model, artificial intelligence system, algorithmic model, or similar technology;
  • Developing, supporting, benchmarking, or improving any competing product, service, database, recruiting platform, analytics platform, marketplace, report product, or similar offering;
  • Republishing, redistributing, selling, licensing, or commercially exploiting data outside the Services;
  • Circumventing technical, contractual, or access restrictions.

This prohibition applies whether access is obtained manually, programmatically, through automated means, through normal use of the Services, through paid access, through shared credentials, or through any other method.

11. Subscriptions, Payments, and One-Time Services

a. Plans and Billing

The Services may include paid subscription plans, annual membership plans, one-time purchases, consulting services, Reports, add-on services, or other paid offerings.

By purchasing a paid Service, you agree to pay all fees disclosed at the time of purchase, plus any applicable taxes.

Unless expressly stated otherwise at checkout, subscription fees are charged in advance for the applicable subscription term.

We currently do not offer monthly subscription plans unless expressly stated for a specific Service. Subscription plans are generally annual.

b. Automatic Renewal

Paid subscriptions automatically renew at the end of the applicable subscription term unless canceled before the renewal date.

By providing a payment method and completing a subscription purchase, you expressly authorize the Applicable SportIntel Entity, its payment processor, and/or its affiliates to charge the payment method on file for the applicable renewal term at the then-current subscription rate, plus applicable taxes, unless you cancel before renewal.

Automatic renewal continues until the subscription is canceled by the account holder.

c. Renewal Notices

We provide advance notice of upcoming subscription renewals by email to the email address associated with the account.

Renewal notifications are typically sent approximately 30 days, 7 days, and 2 days before the renewal date, though timing may vary due to system, payment processor, operational, or legal requirements.

You acknowledge and agree that:

  • The email address associated with your account is the primary method of renewal notice;
  • Renewal notices sent to that email address constitute sufficient and effective notice, subject to applicable law;
  • Failure to open, read, receive, or review renewal notices does not invalidate the renewal or entitle you to a refund except as expressly stated in these Terms or required by law.

d. Responsibility for Account Email

You are responsible for ensuring that the email address associated with your account is accurate, accessible, and actively monitored.

If you register using an email address belonging to a minor, dependent, athlete, parent, guardian, organization, or other third party, you remain responsible for all subscription charges, renewals, cancellations, and account activity.

For accounts associated with athletes under 18, the parent or legal guardian who provides payment information is deemed the account holder and is responsible for all fees, renewals, and subscription management, regardless of which individual’s email address is associated with the account.

e. Cancellation

You may cancel your subscription before the renewal date through your account settings, through any cancellation mechanism provided in the Services, or by contacting us at support@theothersports.com.

Cancellation prevents future renewal charges but does not retroactively refund amounts already paid for the current subscription term unless expressly stated in these Terms or required by law.

If you accepted a subscription online, we will provide an online cancellation mechanism as required by applicable law.

f. Taxes and Price Changes

Fees are exclusive of applicable taxes unless otherwise stated. You are responsible for all applicable taxes, duties, levies, or similar charges.

We may change plan prices, features, subscription terms, renewal terms, or paid offerings prospectively by posting updated information, providing notice, or obtaining consent where required by law.

g. Refund Policy

Unless otherwise stated at the time of purchase or required by law, refunds are available only if requested within 24 hours of the charge being posted.

After this period, all charges are non-refundable.

Refunds are not provided for subscription renewals resulting from failure to cancel before the renewal date, including cases where renewal notices were sent but not reviewed, except where required by law.

Your request should include your name, account email, payment details, Service purchased, and reason for the request.

h. One-Time Services and Consulting Services

Certain SportIntel Services may offer one-time paid services, including consulting services, recruiting guidance, Reports, data reviews, evaluations, profile support, or other professional or advisory services.

Fees, scope, deliverables, and timelines for one-time services will be disclosed at the time of purchase or in a separate written agreement, order form, or statement of work.

Unless expressly stated otherwise, one-time service fees are non-refundable once work has begun.

12. Prohibited Uses

You agree not to:

  • Use the Services for any unlawful, harmful, deceptive, abusive, infringing, or unauthorized purpose;
  • Upload, submit, or transmit content that is defamatory, obscene, harassing, threatening, discriminatory, misleading, infringing, exploitative, or otherwise unlawful;
  • Misrepresent your identity, affiliation, athletic history, recruiting status, authority, or relationship to an athlete, team, school, coach, sponsor, or organization;
  • Claim, edit, or manage a profile you are not authorized to control;
  • Use another person’s account or credentials without permission;
  • Share, resell, sublicense, transfer, or commercially exploit access to the Services without our written permission;
  • Scrape, crawl, harvest, extract, index, copy, cache, or bulk-download data from the Services;
  • Use the Services or data from the Services to build, train, support, benchmark, or improve a competing product or service;
  • Reverse engineer, decompile, disassemble, or attempt to discover the source code, algorithms, methodologies, ranking systems, or analytics systems used in the Services;
  • Circumvent access controls, subscription limits, security features, rate limits, or technical restrictions;
  • Interfere with or disrupt the operation, security, integrity, or performance of the Services;
  • Use bots, scripts, spiders, crawlers, automated tools, or other automated means to access the Services without our written permission;
  • Violate any applicable law, regulation, league rule, school policy, recruiting rule, NCAA rule, NIL rule, or other governing standard.

13. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to notify us promptly of any unauthorized access, suspected security breach, or unauthorized use of your account at support@theothersports.com.

We are not responsible for losses caused by unauthorized account use unless required by law.

14. Third-Party Services and Payment Processors

The Services may integrate with or rely on third-party services, including payment processors, hosting providers, analytics providers, communications tools, authentication services, email services, video platforms, data providers, or other vendors.

Your use of third-party services may be subject to separate terms and privacy policies.

We are not responsible for third-party services, third-party content, third-party platforms, or the acts or omissions of third-party providers.

15. Modification, Suspension, or Discontinuation of Services

We may modify, suspend, restrict, replace, or discontinue any portion of the Services at any time, with or without notice.

This includes features, pricing, plans, Reports, analytics, rankings, profile functionality, data sources, coach tools, sponsor tools, consulting services, or other offerings.

We are not liable for any modification, suspension, discontinuation, data loss, access restriction, or service interruption except as required by law.

16. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, express or implied.

To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and uninterrupted operation.

We do not warrant that:

  • The Services will be error-free, uninterrupted, secure, or available at all times;
  • Athlete profiles, rankings, Reports, analytics, or data will be complete, accurate, current, or reliable;
  • Any athlete will receive recruiting interest, scholarship offers, roster placement, admission, NIL opportunities, sponsorships, coach responses, or other outcomes;
  • Any Report, ranking, recommendation, or analytic output will predict future performance or recruiting results;
  • Any third party will use shared information appropriately or lawfully.

Rankings, ratings, analytics, Reports, and recommendations are opinions, estimates, or informational tools based on available data and methodologies that may change over time.

17. Limitation of Liability

To the fullest extent permitted by law, the Applicable SportIntel Entity, The Other Sports, Inc., and their respective officers, directors, employees, contractors, agents, members, managers, owners, affiliates, licensors, vendors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages arising out of or relating to your use of, or inability to use, the Services.

This includes damages for lost profits, lost revenue, lost data, loss of goodwill, recruiting outcomes, missed opportunities, scholarship decisions, roster decisions, admissions decisions, NIL opportunities, sponsorship opportunities, or other intangible losses, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Services or these Terms will not exceed the greater of:

  • The amount you paid to the Applicable SportIntel Entity for the Service giving rise to the claim during the 12 months before the claim arose; or
  • $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

18. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Applicable SportIntel Entity, The Other Sports, Inc., and their respective officers, directors, employees, contractors, agents, members, managers, owners, affiliates, licensors, vendors, and service providers from and against any claims, demands, actions, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • Your use of the Services;
  • Your violation of these Terms;
  • Your User Content;
  • Your submission, uploading, linking, or sharing of video, images, statistics, profile information, or other content;
  • Any allegation that your User Content infringes, misappropriates, or violates the rights of a third party;
  • Your interactions with coaches, schools, sponsors, recruiters, athletes, parents, guardians, clubs, teams, organizations, or other third parties;
  • Your violation of any law, regulation, rule, policy, recruiting standard, NIL rule, school policy, or third-party right;
  • Any activity occurring under your account.

We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.

19. Profile Removal and Data Deletion

Athletes, parents, or legal guardians may request removal of an athlete profile or deletion of associated personal information by contacting support@theothersports.com.

Upon receiving a valid request, we will take reasonable steps to remove the profile and associated personal information from the applicable public-facing or user-facing portions of the Services, subject to applicable law, identity verification, dispute preservation, security needs, backup systems, legal obligations, financial recordkeeping, fraud prevention, and legitimate business purposes.

Profile removal may not remove information from third parties who previously accessed, received, stored, or used information shared through the Services at your direction or with your authorization.

20. Termination

We may suspend, restrict, or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms, created risk for us or others, misused the Services, failed to pay amounts owed, or engaged in conduct that we determine is harmful, unlawful, or inconsistent with the Services.

You may stop using the Services at any time.

Termination does not relieve you of obligations incurred before termination, including payment obligations, indemnification obligations, ownership restrictions, confidentiality obligations, dispute resolution obligations, or other provisions intended to survive termination.

21. Changes to These Terms

We may update or modify these Terms from time to time.

Changes are effective when posted on the applicable website or otherwise made available, unless a later effective date is stated.

Your continued use of the Services after updated Terms become effective constitutes your acceptance of the updated Terms.

If required by law, we will provide additional notice or obtain consent for material changes.

22. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict-of-law principles.

The Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions below.

23. Dispute Resolution; Arbitration; Class Action Waiver

a. Informal Resolution First

Before filing a claim, you agree to try to resolve any dispute informally by contacting us at support@theothersports.com.

If we cannot resolve the dispute within 30 days after receiving notice, either party may pursue a claim as described below.

b. Binding Individual Arbitration

Except as provided in Section 23(c), any dispute, claim, or controversy arising out of or relating to these Terms or the Services, including formation, performance, breach, termination, enforcement, interpretation, validity, or arbitrability, will be resolved by binding arbitration on an individual basis and not in court.

The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules or, if applicable, its Commercial Arbitration Rules.

The arbitrator has exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement.

Arbitration may be conducted by telephone, videoconference, written submissions, or in person in Davidson County, Tennessee, unless the parties agree otherwise or applicable rules require a different location.

c. Exceptions

Either party may bring a claim in small claims court if it qualifies.

Either party may seek injunctive or equitable relief in court to prevent actual or threatened infringement, misappropriation, unauthorized use, scraping, data theft, misuse of intellectual property, or violation of intellectual property or proprietary rights.

d. Class Action Waiver

You and the Applicable SportIntel Entity agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, representative, private attorney general, or consolidated proceeding.

The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of representative or class proceeding.

e. Jury Trial Waiver

To the fullest extent permitted by law, you and the Applicable SportIntel Entity waive any right to a jury trial for disputes that are not subject to arbitration.

f. Arbitration Opt-Out

You may opt out of the arbitration and class action waiver provisions of this Section by sending an email to support@theothersports.com.

The email must be sent within 30 days of first accepting these Terms and must include the subject line “Arbitration Opt-Out”, your name, and the email address associated with your account.

If you opt out, neither you nor the Applicable SportIntel Entity can require the other to participate in arbitration.

g. Severability

If any portion of this Section is found unenforceable, the unenforceable portion will be severed and the remainder will be enforced to the fullest extent permitted by law.

24. Notices

We may provide notices by email, through the Services, through your account, by posting on the applicable website, or by other reasonable means.

You agree that notices sent to the email address associated with your account are effective when sent, whether or not you open, read, receive, or review them, except where applicable law requires otherwise.

26. Miscellaneous

These Terms, together with any applicable Privacy Policy, order form, service-specific terms, checkout disclosures, or additional terms incorporated by reference, constitute the entire agreement between you and the Applicable SportIntel Entity regarding the Services.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

You may not assign or transfer these Terms or your rights or obligations under them without our prior written consent.

We may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, reorganization, sale of assets, change of control, corporate restructuring, affiliate transfer, or by operation of law.

The provisions of these Terms that by their nature should survive termination will survive, including ownership, license restrictions, payment obligations, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law.

By using the Services, creating an account, claiming or creating a profile, purchasing a subscription, purchasing a one-time service, or otherwise accessing a SportIntel Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
