This Privacy Policy applies to the family of sport-specific websites, platforms, products, and services operated by limited liability companies affiliated with The Other Sports, Inc., a Delaware corporation, including but not limited to SwimIntel, operated by SwimIntel, LLC, EndZoneIntel, operated by EndZoneIntel, LLC, and any additional sport-specific “Intel” service or brand that posts or links to this Privacy Policy.

Each sport-specific company is referred to in this Privacy Policy as the “Applicable SportIntel Entity,” “we,” “us,” or “our.” The particular company responsible for the service you use is the entity identified on the applicable website, order page, invoice, receipt, account page, or service-specific disclosure. The Other Sports, Inc. may provide administrative, technical, operational, billing, customer support, marketing, data, or other services to the Applicable SportIntel Entity.

This Privacy Policy explains how we collect, use, disclose, and safeguard information when you use our websites, software platforms, athlete profiles, reports, analytics, subscriptions, consulting services, communications, and related products and services (collectively, the “Services”).

By accessing or using the Services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Services.

1. Who Can Use the Services

The Services may be used by athletes, parents or legal guardians, college coaches, high school coaches, club coaches, recruiters, schools, clubs, sponsors, brands, and other authorized users. Athlete accounts are intended for individuals aged 14 or older.

Parents or legal guardians may create, claim, or manage accounts and profiles on behalf of athletes under the age of 18. By doing so, the parent or guardian consents to the collection, use, and disclosure of the athlete’s information as described in this Privacy Policy.

The Services are not intended for children under the age of 13. We do not knowingly collect personal information directly from children under 13. If you believe we have collected information from a child under 13, please contact us at support@theothersports.com.

2. Information We Collect

a. Account and Profile Information

We collect personal information necessary to provide and operate the Services. This may include:

  • Name and email address
  • Password credentials or authentication information; we may use third-party authentication and membership management tools to manage accounts and credentials
  • Optional contact information, such as phone number or social media handles
  • Optional biographical information, such as birthday, graduation year, hometown, school, club, team, position, event group, sport-specific details, and “About Me” content
  • Optional physical or athletic attributes relevant to a particular sport, such as height, weight, wingspan, shoe size, position, times, results, statistics, or performance metrics
  • Optional academic information, such as GPA, standardized test scores, intended academic interests, or recruiting preferences
  • Account settings, profile visibility choices, communication preferences, subscription status, and purchase history

b. Athletic and Performance Data

We may collect, display, analyze, or generate sport-specific athletic and performance data. This may include publicly available competition results, team rosters, meet results, game statistics, rankings, times, scores, recruiting information, position data, team data, college program data, performance metrics, and other sport-specific information.

We may also calculate proprietary ratings, rankings, comparisons, fit scores, analytics, projections, or other derived data based on available performance data, user-provided information, public information, third-party data, or our own methodologies.

Athletes and authorized account holders may be able to update certain profile or performance information and are expected to do so truthfully. Providing false, misleading, incomplete, or unauthorized information may result in account suspension, profile removal, or other action.

c. Content You Provide

Users may provide profile photos, written biographies, athletic information, academic information, recruiting preferences, links to race videos or game film, highlight reels, statistics, documents, messages to support, and other content. Depending on the specific SportIntel Service, users may be able to upload images or other files, provide links to third-party video platforms, or submit information for reports, analytics, or consulting services.

We may restrict the types of content that can be uploaded or stored on our servers. For example, some SportIntel Services may allow video links but not direct video file uploads.

d. Payment and Transaction Information

If you purchase a subscription, report, consulting service, or other paid offering, we collect transaction-related information such as the product purchased, subscription status, billing email, renewal date, payment history, and related account information. Payment card details are generally processed by third-party payment processors and are not stored directly by us except for limited billing identifiers, receipts, and transaction records made available by those processors.

e. Communications

We collect information you provide when you contact us by email, submit a support request, respond to a survey, communicate with us through the Services, request profile changes, request deletion, or otherwise communicate with us.

The Services may not provide direct messaging between users unless specifically enabled for a particular SportIntel Service.

f. Usage, Device, and Technical Information

We may automatically collect certain information when you use the Services, including browser type, device type, operating system, IP address, pages viewed, referring pages, interactions with the Services, approximate location derived from IP address, access times, error logs, and other diagnostic or usage information.

3. Reports, Analytics, and AI-Assisted Analysis

The Services may generate written evaluations, Best Fit Reports, Scout Reports, athlete assessments, recruiting summaries, college team analytics, rankings, projections, recommendations, or similar outputs (collectively, “Reports”).

Reports may be based on analyst review, available performance data, user-provided information, public data, video links, sport-specific statistics, team data, college program information, proprietary methodologies, and other relevant information.

We may use artificial intelligence tools or automated systems to assist in generating, reviewing, summarizing, organizing, or improving Reports and analytics. We do not permit third-party AI vendors to train their general-purpose models on user data, Reports, athlete information, or other personal information provided through the Services, unless we disclose otherwise and obtain consent where required by law.

We may use aggregated, de-identified, or anonymized data internally for analytics, product improvement, benchmarking, research, quality control, and development of new features or services.

4. How We Use Information

We use collected information to:

  • Provide, operate, maintain, and improve the Services
  • Create, display, verify, update, and manage athlete profiles
  • Generate and deliver Reports, analytics, rankings, recommendations, and other service outputs
  • Facilitate recruiting visibility for authorized college coaches, recruiters, schools, teams, or organizations
  • Facilitate optional sharing with NIL brand sponsors or other authorized third parties when users opt in
  • Process payments, manage subscriptions, send renewal notices, and administer purchases
  • Provide customer support and respond to inquiries
  • Send administrative, transactional, account, subscription, security, and service-related communications
  • Send marketing or promotional communications where permitted by law and consistent with your preferences
  • Monitor usage, troubleshoot errors, maintain security, prevent fraud, and enforce our Terms of Use
  • Comply with legal, accounting, tax, regulatory, dispute-resolution, and record-keeping obligations

5. Data Sharing and Visibility

a. Profile Visibility

A limited subset of athlete profile information may be visible publicly or to users of the Services, depending on the particular SportIntel Service and profile settings. Public or limited-visible information may include name, school, team, graduation year, sport, position, event group, performance data, rankings, ratings, profile image, and other sport-specific information.

Contact information, academic data, recruiting preferences, Reports, and certain detailed analytics are typically visible only to the athlete, parent or guardian, account holder, authorized college coaches, authorized recruiters, authorized school or team users, or other authorized users as determined by the applicable Service.

b. Optional Sharing with Coaches, Recruiters, Schools, and Sponsors

Athletes, parents, guardians, or account holders may be able to opt in to sharing selected information with college coaches, recruiters, schools, teams, NIL brand sponsors, businesses, or other authorized third parties.

If you opt in, the selected information may be visible to those authorized third parties. Sponsors or brands may view a subset of information when an athlete opts in, but they do not receive access to academic data, recruiting insights, or Reports unless we clearly disclose otherwise or obtain appropriate consent.

We do not control and are not responsible for how third parties use information after it has been shared at your direction or with your authorization.

c. Service Providers

We may share information with trusted third-party service providers that help us operate the Services, including hosting providers, cloud infrastructure providers, payment processors, analytics providers, website and membership management tools, authentication providers, email providers, customer support tools, security providers, data vendors, and professional advisors.

These providers are authorized to use information only as needed to provide services to us or as otherwise permitted by law or their agreements with us.

d. Affiliates

We may share information among the Applicable SportIntel Entity, The Other Sports, Inc., and affiliated sport-specific entities for business operations, customer support, billing, analytics, product improvement, security, compliance, marketing, and administration of the SportIntel family of Services.

e. Legal Requirements and Protection of Rights

We may disclose information if required to do so by law, regulation, legal process, subpoena, court order, governmental request, or similar process. We may also disclose information when we believe disclosure is reasonably necessary to protect the rights, property, safety, or security of the Services, our users, the Applicable SportIntel Entity, The Other Sports, Inc., our affiliates, or others.

f. Business Transfers

We may disclose or transfer information in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, corporate restructuring, change of control, joint venture, or similar business transaction involving the Applicable SportIntel Entity, The Other Sports, Inc., or their affiliates.

6. Cookies and Analytics

We may use cookies, pixels, local storage, log files, and similar technologies to operate the Services, remember preferences, manage sessions, understand how users interact with the Services, improve functionality, and maintain security.

We may use analytics tools such as Google Analytics or similar services to understand usage patterns and improve the Services.

We do not currently use advertising or marketing pixels for targeted advertising unless specifically disclosed for a particular SportIntel Service. If this changes, we will update this Privacy Policy or provide additional notice as required by law.

7. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, maintain accounts and profiles, process transactions, comply with legal and accounting obligations, resolve disputes, enforce agreements, prevent fraud, maintain security, and support legitimate business purposes.

If you request deletion of a profile or personal information, we will take reasonable steps to remove personal information from the Services, subject to identity verification, legal obligations, tax and accounting requirements, transaction records, backup systems, fraud prevention, dispute preservation, and other legitimate business needs.

Transaction and payment records may be retained as required by law or for legitimate business purposes. Aggregated, de-identified, or anonymized information may be retained and used without restriction where permitted by law.

8. Your Rights and Choices

Depending on where you live and the laws that apply, you may have rights to access, correct, delete, obtain a copy of, or opt out of certain uses or disclosures of your personal information. You may also have the right to appeal a denial of a privacy request where required by applicable law.

You may request access to, correction of, or deletion of your personal information by contacting us at support@theothersports.com. We will respond to reasonable requests within a reasonable timeframe and as required by applicable law.

We may need to verify your identity or authority before fulfilling certain requests. If you are submitting a request on behalf of an athlete, minor, dependent, or another person, we may ask for information reasonably necessary to verify your authority to act on that person’s behalf.

You may opt out of non-essential marketing emails by using the unsubscribe link in those emails or by contacting us. You may not be able to opt out of transactional, account, subscription, renewal, security, legal, or service-related communications.

9. Privacy of Minors

The Services may involve information about athletes under the age of 18. Parents and legal guardians should review profiles, account settings, sharing choices, visibility settings, and privacy preferences carefully.

We do not knowingly collect personal information directly from children under 13. If we learn that we have collected personal information directly from a child under 13 without appropriate parental consent, we will take reasonable steps to delete that information.

Parents or legal guardians may request access to, correction of, or deletion of a minor athlete’s personal information by contacting us at support@theothersports.com.

10. Security

We implement reasonable administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, loss, misuse, alteration, or disclosure.

However, no system, website, database, or transmission of information over the internet is completely secure. We cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and for promptly notifying us of any suspected unauthorized access.

11. Third-Party Links and Platforms

The Services may contain links to third-party websites, video platforms, payment processors, authentication providers, social media platforms, schools, teams, sponsors, or other third-party services.

We are not responsible for the privacy practices, content, security, or data handling of third-party websites or services. Your interactions with third-party services are governed by their own terms and privacy policies.

12. U.S.-Only Services

The Services are intended for use by individuals in the United States. We do not knowingly target or market the Services to users outside the United States.

If you access the Services from outside the United States, you understand that your information may be processed in the United States, where privacy laws may differ from those in your location.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Changes are effective when posted on the applicable website or otherwise made available, and the “Last Modified” date will be updated accordingly.
